American traitor?
For the first time in more than 50 years, federal prosecutors are preparing to charge an American citizen with treason. Barring any last-minute complications, the charges will be filed today against Adam Gadahn, the American who has appeared in at least four al-Qaida videos, the most recent one in September.
Treason is the only crime specified in the Constitution and requires either confession in open court or the testimony of at least two witnesses to get a conviction. Prosecutors believe with millions of witnesses to his videos, they have enough proof, but the decision will be controversial, given that so little is known about the circumstances of the videos.
Born Adam Pearlman in California and raised on a goat farm in Riverside Co., he converted to Islam in his late teens. His parents say he moved to Pakistan in 1998. In 2004, the FBI revealed that it believed he was one of a group of al-Qaida terrorists planning some kind of attack later that year. In October of 2004, calling himself "Azzam the American," he first showed up in an al-Qaida video.

I've heard the following statement from people defending our war on terror: Freedom is not free. I believe this is correct. Freedom is not free because millions across the world have to pay the price of our freedom by our corrupt government leaders that we install and support. It is only when those government leaders do not follow our orders do we actually care that they are dictators and that is only to get public opinion favoring action against that leader to displine him.
Our government does not care about us. They care about their true bosses only and everything else is just fluff. The true bosses are billionaries that will do anything to keep making their fortunes larger without regard to human kind.
Yes we have freedom but without that freedom these capitlistic greedy inhumans wouldn't be able to make money. So I guess you can say we are lucky to be born here where we can just go on about our lives ignoring the atrocities that happen in our world.
Al Queda knows these atrocities. They took the fight to the source. We deserved what happened on 9/11 for constnatly turning the other way when our corrupt government hurt millions around the world.
So is treason going against a corrupt government when you see it doing wrong and sacraficing everything for millions in the world? No he is a hero. And if anything happens to him physically we need to destroy our government and I will no longer believe that simply voicing my opinion will help anything. I'm starting to get tired of standing around doing nothing while a great evil continues its conquest of world domination. Its quite obvious that it doesn't matter who we vote into our government and that they are only puppets for those corrupt people that care only about power.
Call me a traitor for thinking that I'm sure you will. I think you are all traitors of mankind though for continuing to let our government do wrong throughout the world while you get to live your comfy life blind to the truth.

The Constitution defines treason as "levying War against" the United States, or "adhering to their Enemies, giving them Aid and Comfort." But what is the definition of an "Enemy" of the United States? As far as I know, the term "Enemy" has a legal meaning only in times of declared war; in the absence of a formal state of war or belligerency, there does not exist an "enemy" in the eyes of the law, and so it is not possible to give "aid and comfort" to such an entity. To call the (possibly fictional) organization "Al Quaida" a legal "enemy" of the United States would seem to have no basis or precedent in law. Has anyone ever been charged with treason before for acts which were not committed during a time of declared war?

Right Debby. Let's just skip the whole trial thing, and sentence him. After all, we no longer have Habeas Corpus now, do we? . We are indicting this person, yet, we have not charged anyone with 9-11. Two wars have been started under the 9-11 umbrella, yet no charges have been filed. Hmmm. Sounds strange, doesn't it? Is he indicted because of videos? Well, then why isn't bin Laden indicted, since there are supposed bin Laden videos accepting responsibility for 9-11? Ins't it the same thing? Sure it is. Folks here ought to start wondering if maybe they are not being played like fiddles by our own Federal government, at least by the fascists currently controlling it.

This is Karl Rove's October surprise. It is nothing but a scare tactic. This kid is doing this because his Grandad is Mossad and is putting him up to it. It is merely a scheme to drum up more anti-Muslim paranoia. "Oh noooo! they're converting our kids! Let's nuke them before they convert any more!" This is so transparent it's sad...I can't believe any of you are even taking this seriously. I really expected better from Rove this year...maybe he's busy covering his tracks to avoid implication in Pagegate.

US Constitution, Section 3 - "Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court. The Congress shall have power to declare the Punishment of Treason, but no Attainder of Treason shall work Corruption of Blood, or Forfeiture except during the Life of the Person attainted."
I posted this for those that stated there was no "aid and comfort" clause. However, to be guilty of treason you must levy war against the United States, etc. Levying war on the US is legal in certain circumstances. If the government has become so corrupt that it is dysfunctional, it is legal and the responsibility of ALL US CITIZENS to overthrow the government. "Azzam" here can only be found guilty of treason, if the US government can prove that it is not corrupt. "Azzam", in my book, has a great defense. He was simply following the Constitution, attempting to overthrow a corrupt regime. The burden is on the government, who seeks to prosecute "Azzam". I think there is a great deal of evidence indicating that the US government is corrupt; most recently, the overturning of the US Constitution's rule on Habeas Corpus. Only a corrupt government would overturn Habeas Corpus, a law which clearly states cannot be suspended except for very specific circumstances, which have not been met.
This is all a moot point, since "Azzam" is likely a spook; a CIA operative, a false flag stooge.

I do not understand these people who think this guy has a right to help someone destoy lives in America. He is an American citizen, right? He is helping the enemy plot our destruction, why are so many people defending him? If we have proof then sentence him, but we probably shoudl catch him first!

No wonder the U.S.A. is in such danger of being torn apart from the inside. We are no longer "one nation under God", we have become divided and we all know what happens when a nation is divided against itself. No matter what - I stand behind my son and every other soldier that is risking their lives for a nation of people that for the majority just don't seem to care about whats right and wrong. I would die for you to protect you from harm ...........I would seekout and find those that would threaten you and your family ..........thats the right thing to do. I would attempt to keep you safe - no matter what.

I don't see anything in that definition that states providing aid and comfort to the enemy? I think he may be able to be charged with treason, it is up to the courts and a jury of his peers to decide. I am not a lawyer, so I really have no expertise here.

Kangaroo courts are for dictatorships.
The U.S. Constitution, Bill of Rights. ect are there to protect ALL U.S. citizens' rights, not just those whom are in power and/or in the majority opinion. Dissent helps to keep us a thinking, viable republic. We need dissent as 'food' for our great collective mind.
We must to keep our high moral ground here, not give into a mob mentality and convict this guy without his day in court. To do otherwise is to continue to slowly kill our grand experiment in democracy, further restricting our rights and privacy. If we give in to the urge to give up our rights for safety, then we are no better than those who wish to terrorize and kill us. The terrorist will have won, they will have destroyed The American Dream.
If this dude is guilty of treason or lessor crimes, it needs to be proven in court. If he deserves to 'hang' then he should, but until a conviction, he is to be considered innocent.
I realize the available evidence appears to be a slam dunk, however, in order to remain a great nation, we must continue to abide by our principles and give this guy a fair trial. To do less is hypocritical and makes us no better than those who wish to destroy us.

I find it very alarming that so many people in this country still refuse to accept the fact that regardless of what you may think - the world is not as you perceive it. Not everybody does bad things "under duress" as so many of you are suggesting he has. He CHOSE to be connected to a high profile group that hates and kills not in the name of god for a greater purpose, but no - because they believe THEY will be axalted at death. Guilt by association - how many more innocent people need to die - maybe someone close to home for you - before you realize its US against THEM. If it looks like a duck - quacks like a duck - and waddles like a duck - guess what folks...........pull your heads out of the sand and look around you - you could be next.

First of all, it is an insult to all American's to even mention that he is, in fact, an American. I don't understand why some American's feel compassion for someone like this. This isn't about politics or religion, this is about treason. He has sided with the enemy and is trained to murder innocent Americans. Our servicemen and women have enough to worry about over there, let alone some Taliban want-to-be who didn't have any friends growing up. Pat Tillman and the rest of our troops are dying because of a person like this? Execute this coward!

Adam Pearlman frightens me. He is one of several young Americans who have fallen under the spell of radical Islam. In another time, for a different cause, his actions might be called heroic. Today he is a traitor. Earlier Americans plotted and propagandized against their homeland during conflict, and were prosecuted and punished as traitors. He deserves the same.
Undue introspection regarding Adam's conversion is unnecessary. Our nation is large enough to produce, quite naturally, its share of converts to many causes. We should not abide those true malcontents who make war against us.

This man is openly asking for people to commit atrocities on United States soil. I think that is grounds enough to be tried and convicted of treason. Interestingly enough though, you must be a citizen to be tried for treason, and I'm almost sure that in the legal framework of a U.S. passport it states that should you fight for an enemy of the United States that you forfeit your citizenship.
Even if our country was founded by traitors, they risked life and liberty and property in pursuit of a home in which one can live in peace according to those pricipals laid out by Locke, Rousseau, and Voltaire among many others, not to actively seek out and cause harm to others.
